JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 13-07-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered under Section379 of the Indian Penal Code. Petitioner is not named in the first information report but in course of investigation, police raided a hotel and four persons including the petitioner were arrested and they confessed that they committed the theft of article but except the aforesaid confessional statement, there appears to be nothing against the petitioner. Moreover, petitioner is in jail custody since 25-022016 but uptill now, he has not been put on test identification parade.
Considering the above-said facts and circumstances of
Patna High Court Cr.Misc. No.23695 of 2016 (3) dt.13-07-2016 2/2 the case as well as submission of the parties, let the petitioner named above, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each in connection with Gandhi Maidan P.S.
