====================================================== CORAM: HONOURABLE MR. JUSTICE SANJAY PRIYA ORAL ORDER 29-07-2019 Heard learned counsel for the petitioner and the State.

The petitioner seeks bail in Runnisaidpur P.S. Case No. 473 of 2016, instituted for the offence under Section(s) 193, 204, 468, 471, 420, 120B and 506/34 of Indian Penal Code.

Counsel for the petitioner submits that petitioner is not named in the written report. In the written report the main allegation is against Randhir Rai @ Harendra Sahni. During investigation the petitioner has been made accused because he is brother of Randhir Rai @ Harendra Sahni. Counsel for the petitioner further submits that other co-accused have already been granted bail by coordinate Benches of this Court vide orders dated 15.5.2017 and 5.6.2017 passed in Cr. Misc. 22763

Patna High Court CR. MISC. No.38368 of 2019(3) dt.29-07-2019 2/2 of 2017 and 17500 of 2017 respectively.

Petitioner is in custody since 17.12.2018.

Considering the aforesaid facts and circumstances of the case, prayer of the petitioner for grant of bail is allowed. Let the petitioner above named, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Sitamarhi, in connection with Runnisaidpur P.S. Case No. 473 of 2016, subject to the condition that both the bailors will be close relatives of the petitioner.
