JUSTICE DINESH KUMAR SINGH ORAL ORDER 16-08-2016 The petitioner is languishing in custody since 29.04.2016 in a case registered for the offences punishable under Sections 21(b), 22(a) of the N.D.P.S. Act. From the possession of the petitioner 20 grams of Ganja and 30 grams of small polythene sachets were recovered.
It is submitted by learned counsel for the petitioner that even assuming the accusation, only small quantity of ganja has been recovered.
A statement has been made in para 3 of the petition that petitioner has no criminal antecedent. Mr. J.N. Thakur, learned counsel for the State does not controvert the quantity of recovery. Considering the quantity of recovery, let the petitioner, above named, be released on bail on furnishing bail
Patna High Court Cr.Misc. No.30518 of 2016 (3) dt.16-08-2016 2/2 bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned 1st Additional Sessions Judge-cum-Special Judge(NDPS Act), Darbhanga in connection with Bahadurpur(Pator O.P) P.S. Case No. 164 of 2016.
