JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 18-03-2017 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. The petitioner is in custody in POCSO Case No.9/17 arising out of Sherghati (Dobhi) P.S. Case No.418/16 registered under Section 366(A) of the Indian Penal Code and Section 12 of POCSO Act.

Accusation is of kidnapping of Ranju Kumari, sister of the informant, by this petitioner for the purpose of marriage. Learned counsel for the petitioner submits that the petitioner has falsely been implicated due to personal grudge and enmity with the informant.

It appears that the victim in her statement recorded under Section 164 Cr.P.C. has supported the prosecution case

Patna High Court Cr.Misc. No.12261 of 2017 (2) dt.18-03-2017 2/2 about her enticing away by this petitioner who was recovered by the police from the house of the petitioner.

Having considered the aforesaid facts and circumstances of the case, I am not inclined to grant bail to the petitioner. The prayer for bail of the petitioner is rejected. (Rajendra Kumar Mishra, J) AnilKrSinha/- U
