Petitioner, namely, Santosh Kumar is in custody since 25.05.2016 in connection with Sursand P.S. Case No.05 of 2015 under Sections 363, 366 and 366A of the Indian Penal Code. The allegation according to F.I.R. is that the daughter of the informant has been abducted by the petitioner with intention to marry her.

The daughter of the informant has been recovered and her statement under Section 164 Cr.P.C. has been recorded which has been annexed as Annexure-3. From perusal of the statement of the daughter, namely, Guriya Kumari, it appears that she is aged about 19 years and she has stated that the petitioner and she

Patna High Court Cr.Misc. No.34973 of 2016 (2) dt.20-08-2016 married and were living as husband and wife and further she desires now also to live with the petitioner. In view of the statement of the girl i.e. daughter of the informant, who is aged about 19 years, I direct that the petitioner above named be released on bail on furnishing bail bond of Rs.10,000.00 (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned S.D.J.M., Pupri at Sitamarhi in connection with Sursand P.S. Case No.05 of 2015.
