This is an application for bail in connection with Deepnagar P.S.Case No. 216 of 2016 registered for the offences punishable under Sections 147, 148, 149, 341, 323, 307, 302 of the Indian Penal Code and Section 27 of the Arms Act. Submission of learned counsel for the petitioner is that petitioner is not assailant of the deceased and though there is general and omnibus allegation also of assault to the deceased by all the accused persons, including the petitioner, only allegation against the petitioner is that he brought rifle and handed over to other accused, who fired and petitioner is in custody since 23.11.2016.

Heard learned APP also, who has opposed the prayer

Patna High Court Cr.Misc. No.6956 of 2017 (2) dt.17-02-2017 2/2 for bail.

In view of the fact that there is allegation against petitioner that he handed over rifle to other accused, who fired, I am not inclined to grant bail to the petitioner at this stage. However, petitioner may renew his prayer for bail after framing of charge in this case.

With the above observations, this application is dismissed.
