Heard learned counsel for the petitioner and learned APP for the State.

The petitioner seeks bail in a case registered under Sections 447, 324, 307/34 of the Indian Penal Code and 27 of the Arms Act.

Allegation is that the accused persons fired upon the informant causing injury in his thigh.

It has been submitted on behalf of the petitioner that the petitioner is in custody since 30.06.2020 and has got no criminal antecedent. Charge sheet has been submitted in this

Patna High Court CR. MISC. No.37075 of 2020(2) dt.02-02-2021 2/2 case. There is no allegation of tampering of witnesses alleged against the petitioner. The petitioner has falsely been implicated in the present case. As per the statement of the victim, the specific allegation is against the co-accused Munnu Singh. The alleged occurrence is said to have taken place at 11 P.M. in the night. The prosecution has not disclosed the source of identification.

On behalf of the State, it is submitted that the petitioner is named in the F.I.R.

Considering the aforesaid facts and circumstances, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Sitamarhi in connection with Runnisaidpur P.S. case No.198 of 2019.
