JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 11-08-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered for the offences punishable under Sections 399, 402, 414 of the Indian Penal Code and Sections 27(1-B)A/26/35 of the Arms Act. One country made loaded pistol along with two live cartridges and one black colour wallet are said to have been recovered from the conscious possession of the petitioner, when he along with others had assembled for committing dacoity. The petitioner does have criminal antecedent but submission on behalf of the petitioner is that co-accused Brijesh Kumar and Awadhesh Kumar Gupta have already been granted privilege of bail. The petitioner is in jail custody since 05.01.2016.
