The Petitioner seeks bail in Aurai P.S. Case No. 131 of 2015, pending in the Court of learned Judicial Magistrate, 1st Class, Muzaffarpur instituted for the offence under Section(s) 304(B), 34 of the Indian Penal Code. The petitioner is husband of the deceased.

There is allegation in the written report that petitioner informed to the informant on mobile that his daughter has died due to burn injury and thereafter switched off the mobile phone. The informant went to the Sasural of his daughter and did not get any trace of his daughter. The informant found that petitioner and other accused had absconded after disposing of the dead body of

In this manner, the deceased died unnatural death in her Sasural. This petitioner informed on mobile to the informant about death of his daughter by burn injury but when the informant reached the Sasural of the victim, the dead body was disposed of and petitioner was also found absconding. In such circumstance, this Court is not inclined to grant bail to the petitioner. The prayer of the petitioner for bail is rejected.

However, the petitioner may renew his prayer for bail after nine months if no substantive progress is made in the trial.
