The petitioner apprehends his arrest in a case registered for the offence under Section 307 & other allied sections of the Indian Penal Code and Section 27 of the Arms Act.

As per the F.I.R., the allegation against the petitioner is that he alongwith other co-accused firstly forcibly took away two motorcycles i.e. of informant and one Ravi Kumar, and thereafter, assaulted them.

It is submitted on behalf of petitioner that as per F.I.R., there is general and omnibus allegation of assault. Specific allegation of assault is against other co-accused persons. Petitioner has got clean antecedent. Learned A.P.P. for the State has opposed the bail petition.

No.49141 of 2021(2) dt.21-06-2022 2/2 Considering the aforesaid facts and circumstances as well as general & omnibus nature of allegation and clean antecedent of petitioner, let the above named petitioner, in the event of his arrest/surrender within a period of six weeks from today, be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M. 1st Danapur, Patna in connection with Bihta P.S. Case No. 782 of 2015, subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure.
