JUSTICE DINESH KUMAR SINGH ORAL ORDER 20-05-2015 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a case registered for the offences punishable under Sections 419,420 and 506 of the Indian Penal Code.

It is alleged that the petitioner being tutor of the children of the informant received Rs.4,50,000/- on assurance to provide employment to the husband of the informant.

It is submitted by the learned counsel for the petitioner that neither there is any proof with regard to the payment nor there is any paper with regard to such assurance. The present case has been lodged in order not to make payment of due remuneration to the petitioner. Statement has been made in paragraph 3 of the

Patna High Court Cr.Misc. No.21558 of 2015 (2) dt.20-05-2015 2/2 petition that the petitioner has no criminal antecedent. It is further submitted that the informant cannot claim any right by virtue of an illegal contract.

Considering the aforesaid facts, let the above named petitioner be released on anticipatory bail in the event of arrest or surrender before the learned Court below within a period of twelve weeks from today on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned JM Ist Class, Patna in connection with Kankarbagh P.S. Case No. 313 of 2014 subject to the conditions as laid down under Section 438(2) Cr.P.C.
