Petitioner is languishing in custody since 19.5.2016 in a case registered for the offences under Sections 21(a)(b) & 22(a)(b) of the N.D.P.S. Act.

Prosecution case is that from the betel shop of the petitioner, two Puriya Ganja, two pocket cigarettes and cash of Rs.10/- were recovered.

It is submitted by learned counsel for the petitioner that the weight of ganja has neither been mentioned in the F.I.R. nor in the seizure list. This fact has not been controverted by the learned A.P.P. It is further submitted that admittedly, the recovery

The statement has been made in paragraph-3 of the petition that the petitioner has got no criminal antecedent. Considering the facts and circumstances, let the petitioner above named be released on bail on his furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of 1st Additional Sessions Judgecum-Special Judge (NDPS Act), Darbhanga in connection with Bahadurpur P.S. Case No.195 of 2016.
