JUSTICE SUNIL KUMAR PANWAR ORAL ORDER 04-03-2022 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner is apprehending his arrest in a case registered in connection with Bhagwan Bazar P.S.Case No. 264 of 2021 for the offences punishable under Sections 30(a) of the Bihar Prohibition and Excise Act .

As per allegation in the F.I.R 30 liters illicit liquor was recovered from house of Ranjit Sharma.

Learned counsel for the petitioner submits that petitioner's name has been surfaced on the basis of confessional statement of co-accused persons, who were caught on the spot. Nothing has been recovered from possession of the petitioner. Petitioner was not caught on the spot and he has no concerned with the said liquor. Petitioner has got no criminal antecedent.

Patna High Court CR. MISC. No.49051 of 2021(2) dt.04-03-2022 2/2 Learned Additional Public Prosecutor opposed the bail prayer of the petitioner.

Considering the facts and circumstance of the case as well as submission of the parties, let the petitioner in the event of his arrest or surrender before the Court Below within a period of four weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned 2nd Additional Sessions Judge cum Special Judge Excise, Saran at Chapra in connection with Bhagwan Bazar P.S Case No. 264 of 2021 subject to the conditions as laid down under Section 438(2) of the Cr.P.C .
