JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 25-07-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered for the offence punishable under Section 392 of the Indian Penal Code. Petitioner is not named in the First Information Report but in course of investigation, he was arrested in connection with another case and his confessional statement was recorded and on the basis of his confessional statement, Rs. 10100/-was recovered from his house. The prosecution claims that the aforesaid recovered amount is looted property of the present case.

Submission on behalf of the petitioner is that the aforesaid recovery is nothing but only the high handedness of

No.28788 of 2016 (3) dt.25-07-2016 2/2 the police and as a matter of fact, the seized amount belongs to the petitioner but with an intention to implicate the petitioner, in the present case, the police claimed that the seized amount was looted property of the present case.

Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Siwan, in connection with Bhagwanpur Hat P.S. Case No. 214 of 2015.
