The petitioner seeks bail in connection with Sessions Trial No. 73 of 2009 arising out of Mirganj P.S. Case No. 98 of 2008 registered under Section 366A of the Indian Penal Code. The case was fixed for recording the statement of the accused under Section 313 of the Code of Criminal Procedure on 04.09.2013, but the petitioner could not appear and consequently his bail bond was cancelled.

Leanred counsel for the petitioner submits that the petitioner is in jail since 07.03.2017 for misuse of privilege of bail.

Considering the facts aforesaid and the fact that the petitioner has already remained in jail for more than 11⁄2 months,

Patna High Court Cr.Misc. No.19163 of 2017 (2) dt.27-04-2017 2/2 the above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Sessions Judge-V, Gopalganj in connection with Sessions Trial No. 73 of 2009 arising out of Mirganj P.S. Case No. 98 of 2008 with condition that the petitioner shall appear before the court below on each and every date till disposal of the case.
