2. This is an application for regular bail on behalf of the petitioner for the offences alleged under Sections 387, 307, 34, 120(B) of the Indian Penal Code and Section 27 of the Arms Act, registered in connection with Habibpur P.S.Case No. 04 of 2024.
3. According to the FIR, when the informant was going with his accomplice Md. Azzu, three named accused persons, namely, Md. Sonu, Md. Imtiyaz and Md. Firdous (petitioner) who were on two motor-cycles, came there having pistol and one of them fired at his back.
4. The learned counsel for the petitioner has submitted that the informant and other three witnesses examined till date
Patna High Court CR. MISC. No.37664 of 2025(5) dt.29-08-2025 2/2 did not support the prosecution case. The informant during his deposition has denied the occurrence.
5. Considering the above facts and circumstances, let the petitioner, above-named, be released on bail on furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned ACJM-IX, Bhagalpur in connection with Habibpur P.S.Case No. 04 of 2024, subject to the following conditions:-
1. The the petitioner shall cooperate in the disposal of trial and make himself available as and when required by the court.
2. Before accepting the bail bond, the court below shall verify the criminal antecedents of the petitioner, and if it is found that he is involved in any other criminal case, except the present one, his bail bond shall not be accepted.
