JUSTICE DINESH KUMAR SINGH ORAL ORDER 24-06-2015 Heard learned counsels for the petitioners and the State. The petitioners are apprehending arrest in a case registered for the offences punishable under sections 147,148,149,323,341,342,504,506 and 379 of the Indian Penal Code.
It is alleged that the accused persons snatched one lac twenty thousand rupees from the informant.
It is submitted by learned counsel for the petitioners that since the informant and his employer are operating a liquor shop in the residential area which was opposed by the petitioners, hence the present case has been lodged. It is further submitted that
Patna High Court Cr.Misc. No.22733 of 2015 (2) dt.24-06-2015 2/2 mother of petitioner nos. 1 and 2 lodged Complaint Case No. 702 of 2015 against the informant.
Considering the specific accusation against petitioner no. 1 Balwant Singh alias Tola Singh, let the learned court below consider the prayer for regular bail of the petitioner no. 2 in case the petitioner no. 2 surrenders within six weeks from today in connection with Purnea Sadar P.S. Case No. 78 of 2015 pending in the court of learned C.J.M., Purnea.
So far as petitioner nos. 1, 3 and 4 are concerned, since there is no specific accusation against them, let the above named petitioner nos. 1,3 and 4 be released on anticipatory bail in the event of arrest or surrender before the learned Court below within a period of twelve weeks from today on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned CJM, Purnea in connection with the aforementioned case subject to the conditions as laid down under Section 438(2) Cr.P.C.
