JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 21-10-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered for the offences punishable under Section 302 of the Indian Penal Code and Section 27 of the Arms Act.

Petitioner is not named in the first information report and it is alleged that some unknown persons committed the murder of the deceased. During course of investigation, one coaccused, Awadh Kishore was arrested and made his confessional statement disclosing his involvement as well as others but the aforesaid co-accused did not name the petitioner. However, in supervision note for the first time name of petitioner came to light at Para-102 of the case diary but no specific overt-act has been attributed against the petitioner even in the supervision note of

Patna High Court Cr.Misc. No.31610 of 2016 (4) dt.21-10-2016 2/2 Dy.S.P. No doubt, petitioner carries criminal antecedent of several cases but in the present case except suspicion, there is nothing against him.

Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Begusarai in connection with Begusarai Town P.S. Case No. 242 of 2010.
