The petitioner seeks bail in Katoriya (Suiya) P.S. Case No.20 of 2015 instituted for the offences under Sections 302, 364,m 201 and 120(B)/34 of the Indian Penal Code. This is the second time when the petitioner has approached this Court for regular bail.

Perused status report submitted by I/C District & Sessions Judge, Banka wherein it has been stated that out of 13 charge sheet witnesses, altogether 9 witnesses have been examined.

Learned counsel for the petitioner submits that except one witness all witnesses have been examined.

Patna High Court Cr.Misc. No.22158 of 2018 (3) dt.16-05-2018 In such view of the matter, this Court is not inclined to enlarge the petitioner on bail. Accordingly the prayer for bail is rejected. However, the trial court is directed to conclude the trial within a period of five months from the date of receipt/production of a copy of this ruder subject to cooperation extended by the petitioner.
