JUSTICE SUDHIR SINGH ORAL ORDER 02-09-2015 Heard the learned counsel for the petitioner and the learned counsel for the State.

The petitioner apprehends his arrest in a case registered for the offence punishable under Sections 147, 148, 149, 323, 504, 436 and 452 of the Indian Penal Code. The allegation against the accused including the petitioner is to have entered into the house of the informant, abused and assaulted the inmates of the house and on the order of the accused Ganesh Thakur, other accused set fire at the house of the informant, which caused loss of Rs.50,000/-. On behalf of the petitioner, it is submitted that the petitioner has got no criminal antecedent. As per the prosecution case, the alleged date of occurrence is 27.12.2013, but the case

Patna High Court Cr.Misc. No.22925 of 2015 (3) dt.02-09-2015 2/2 was instituted on 10.01.2014, for which, no explanation has been made. From perusal of the complaint case, it appears that there is no specific allegation made against the petitioner. On behalf of the State, it is submitted that the petitioner is named in the First Information Report/complaint case.

Considering the facts and circumstances of the case, let the petitioner above-named be released on bail in the event of his arrest or surrender within a period of four weeks on furnishing bail bond of Rs.10,000/- with two sureties of the like amount each to the satisfaction of Sri Ashish Mishra, Judicial Magistrate-1st Class, Purnea in connection with Dhamdaha P.S. Case No.18 of 2014 subject to the condition as laid down under Section 438 (2) of the Code of Criminal Procedure. (Sudhir Singh, J) V.K. Pandey/- U T
