The petitioner has preferred this application for grant of regular bail in a case registered under sections 30(a) and 56(b) of the Bihar Prohibition and Excise Act, 2016. As per the prosecution case, 4200 litres of liquor was recovered from the truck being driven by this petitioner. It is submitted by learned counsel for the petitioner that the petitioner has been falsely implicated in the case. He has no criminal antecedent. Further, referring to the prosecution report it is submitted that the owner was himself present and he managed to escape. The petitioner is in custody since 6.4.2021 and has no criminal antecedent.

Having heard learned counsel for the parties and

Patna High Court CR. MISC. No.49236 of 2021(2) dt.21-02-2022 2/2 taking into consideration the facts of the case specially the petitioner not having any criminal antecedent, the Court directs the petitioner to be enlarged on bail in connection with G.O P.S. Case no. 186 of 2021 on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional District and Sessions Judge II-cum-Special Judge, Nawada.
