2. The petitioner apprehends his arrest in a case registered for the offence under Sections 30(a), 32, 41(1) of Bihar Prohibition and Excise Act.

3. 15 liters of illicit country-made liquor has been recovered behind bushes adjacent to house of this petitioner.

4. It is submitted on behalf of petitioner that nothing has been recovered from the conscious possession of the petitioner. Recovery has been made from an open place. Petitioner claims clean antecedent.

5. Considering the nature of allegation and clean antecedent of petitioner, let the above named petitioner, in the event of his arrest or surrender within a period of six weeks from today, be enlarged on bail on furnishing bail-bond of Rs.

Patna High Court CR. MISC. No.41752 of 2023(2) dt.04-08-2023 2/2 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Special Excise Court No. 2, East Champaran, Motihari in connection with Aadapur P.S. Case No. 104 of 2023, subject to conditions as laid down under Section 438(2) of the Cr.P.C.
