Mr. Kalyan Shankar, APP ====================================================== CORAM: HONOURABLE MR. JUSTICE SATYAVRAT VERMA ORAL ORDER 25-06-2025 Heard learned counsel for the petitioners and learned APP for the State and learned counsel appearing on behalf of the informant.
2. The petitioners apprehend their arrest in a case registered for the offences punishable under Sections 115(2), 118(1), 126(2), 109, 352, 351(2) and 3(5) of the Bharatiya Nyaya Sanhita.

The learned counsel for the petitioners submit that petitioners are a person with clean antecedent and the informant alleges that discussion regarding marriage of the daughter of Umesh was scheduled in between son of the informant namely, Raman along with co-villagers were present, when accused persons including the petitioners came variously armed and
Patna High Court CR. MISC. No.37572 of 2025(2) dt.25-06-2025 2/3 Sunil, Shivam and Prince assaulted Raman causing injury on head, thereafter parven and Prem assaulted by fist, thereafter the injured brought to the hospital.
4. The learned counsel submits petitioners have been falsely implicated in the instant case by the informant. It is next submitted petitioners and the informant are agnates and are having dispute relating to property. It is further submitted that father of the petitioners died and after rituals were performed on 21.04.2025 as such the petitioners did not go to attend the discussion regarding marriage of the daughter of Umesh but then they came to be implicated falsely. It is next submitted that even allegation of assault is not specific. It is next submitted that the injury report clearly record that the injury suffered by the injured is simple in nature which amply demonstrates that if three accused had assaulted the informant's son, in that event the victim would not have suffered simple injury.
5. The learned APP and learned counsel appearing on behalf of the informant opposes but then are not in a position to rebut the submission of the learned counsel appearing on behalf of the petitioners made based on Annexure- 2 that injury suffered by the injured is simple in nature.
6. Considering the submissions made by the learned

No.37572 of 2025(2) dt.25-06-2025 3/3 counsel for the petitioners, the petitioners above-named, in the event of their arrest or surrender before the learned trial court within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned trial court where the case is pending/successor court in connection with Raiyam P.S. Case No. 27 of 2025, subject to the conditions as laid down under Section 482 (2) of the BNSS.
