JUSTICE PARTHA SARTHY ORAL ORDER 04-02-2021 Heard learned counsel for the petitioner and learned counsel for the State through video conferencing. The petitioner has filed the instant application for grant of regular bail in connection with Sahiyara P.S. Case no. 86 of 2019 registered under sections 498A, 341, 323, 494, 504 and 34 of the Indian Penal Code and sections 3 and 4 of the Dowry Prohibition Act.
As per allegation in the FIR, the informant was married to the petitioner in the year 2017. The petitioner and other accused persons physically and mentally tortured the informant for non-fulfilment of demand of dowry of a motor cycle and Rs. 1 lakh in cash.
It is submitted by learned counsel for the petitioner that the allegation as levelled in the FIR are false and concocted. He happens to be the husband of the informant and is in custody
Patna High Court CR. MISC. No.37542 of 2020(2) dt.04-02-2021 2/2 since 24.1.2020.
The application for bail is opposed by learned APP for the State.
Having heard learned counsel for the parties and taking into consideration the petitioner being in custody since 24.1.2020, the petitioner is directed to be enlarged on bail in connection with Sahiyara P.S. Case no. 86 of 2019 on furnishing bail bond of Rs.10,000/ (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Sub-Judge 5th, Sitamarhi.
