The petitioner has preferred this application for grant of regular bail in a case registered under section 411 of the Indian Penal Code and sections 25(1-B) (a), 26 and 35 of the Arms Act.
As per the prosecution case, one country made pistol loaded with two cartridges was recovered from the possession of the petitioner.
It is submitted by learned counsel for the petitioner that no incriminating article has been recovered from the petitioner's possession who has been falsely implicated in the case. The petitioner is in custody since 20.6.2021 and chargesheet has been submitted in the case.
It is further submitted by learned counsel for the
Patna High Court CR. MISC. No.49528 of 2021(2) dt.06-10-2021 2/2 petitioner that the urgency in taking up this matter out of turn is that the grand mother of the petitioner died on 28.9.2021. Heard learned A.P.P. for the State.
Having heard learned counsel for the parties and taking into consideration the facts of the case together with the chargesheet having been submitted in the case, the Court directs the petitioner to be enlarged on bail in connection with Brahmpur P.S. Case no. 312 of 2021 on furnishing bail bond of Rs.10,000/ (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned C.J.M. at Buxar.
