The husband-petitioner has challenged the order dated 09.02.2015 in Divorce Case No.07 of 2014 passed by Principal Judge, Family Court, Saran at Chapra directing the petitioner to pay maintenance of Rs.3,000/- per month under Section 24 of the Hindu Marriage Act to the wife and minor daughter. From perusal of the order passed by the court below, it appears that the court below has considered the case of both the parties and then recorded finding that the income of the petitioner is more than Rs.10,000/- per month. Admittedly minor child is there, who is residing with the wife.
In my opinion, therefore, in these days when the court below has only directed to pay Rs.3,000/- under Section 24 of the Hindu Marriage Act which is interim, no interference can be made
Patna High Court CWJC No.7783 of 2015 (2) dt.07-04-2016 in supervisory jurisdiction under Article 227 of the Constitution of India.
Thus, this writ application is dismissed.
