JUSTICE SUDHIR SINGH ORAL ORDER 09-09-2016 Heard learned counsel for the petitioners and the State. The petitioners seek bail in a case instituted for the offences under Sections 302 and 201/34 of the I.P.C. The prosecution story, in brief, is that on 5.6.2013 the informant came to know that his sister Rita Devi, wife of Raju Mandal, resident of village Dumrigarh fell into the well, which is situated west from the village Dumrigarh and she has died. Thereafter the informant reached at matrimonial village of his sister at Dumrigarh, but nobody was present at the said well and in the meantime Raushanganj Police arrived there and started to search the dead body of the sister of the informant. The informant suspected that the in-laws along with the petitioners committed the murder of his sister.

No.30147 of 2016 (3) dt.09-09-2016 2/2 It has been submitted on behalf of the petitioners that the petitioners are in custody since 19.2.2016 and the charge sheet has been submitted in the present case. The petitioners have got no criminal antecedent. There is no allegation of tampering of witnesses alleged against the petitioners. The petitioners are separate in mess and property from the husband of the deceased. Petitioner No.1 is the mother-in-law of the deceased and petitioner No.2 is the Gotiya of the husband of the deceased. On behalf of the State, it is submitted that the petitioners are named in the F.I.R.

Considering the aforesaid facts and circumstances, it is directed that the petitioners above named be released on bail on furnishing bail bond of Rs. 10,000/-(Ten thousand) each with two sureties of the like amount each to the satisfaction of learned Sub Divisional Judicial Magistrate, Sherghati at Gaya in connection with Raushanganj P.S. case No.29 of 2013.
