====================================================== CORAM: HONOURABLE MR. JUSTICE BIRENDRA KUMAR ORAL ORDER 12-03-2021 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.
The petitioner is languishing in custody for the offences punishable under Sections 341/323/147/148/ 149 /307 / 504 of the Indian Penal Code. Later on offence under Section 302 of the Indian Penal Code was added.
According to FIR, on the order of this petitioner six other named accused persons assaulted to the informant and his brother as a result whereof brother of the informant died. Learned counsel for the petitioner submits that the post mortem report would reveal that single injury on the head was there and that is not specific against anyone. Moreover, there is no allegation of any overt-act against the petitioner. The
Patna High Court CR. MISC. No.38299 of 2020(3) dt.12-03-2021 2/2 petitioner is in custody since 09.05.2020. The petitioner has stated on oath that he has got no criminal antecedent. Learned counsel for the informant opposed the prayer for bail.
Considering the facts aforesaid, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.20,000/- (Twenty Thousand) with two sureties of the like amount each to the satisfaction of the learned Court-below where the case is pending in connection with Karpi (Sehar Telpa O.P.) P.S. Case No.83 of 2020, with following conditions: (a) Both the bailors shall be the resident of territorial jurisdiction of the learned Court-below.
(b) The petitioner shall fully cooperate with the trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
(c) The petitioner shall not leave the country without permission of the trial Court.
