Let the defect(s), if any, be removed within a period of four weeks from today.

The petitioner seeks bail in connection with N.D.P.S. Case No. 03 of 2023 arising out of Mithanpura P.S. Case No. 387 of 2022 registered for the offence under Sections 25(1-b)a, 26, 35 of the Arms Act and Sections 8, 20(b)(ii)(B), 8(c), 21(c) of the N.D.P.S. Act.

8 gram of smack like substance has been recovered from the possession of the petitioner.

The petitioner has clean antecedent and the recovery is less than the commercial quantity and he is in custody since 04.11.2022.

Learned A.P.P. has vehemently opposed the prayer for bail.

Patna High Court CR. MISC. No.41864 of 2023(2) dt.14-07-2023 2/2 Considering the period of custody, this application for regular bail is allowed.

Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional District and Sessions Judge-3rd-cum-Special Judge, N.D.P.S., Muzaffarpur in connection with N.D.P.S. Case No. 03 of 2023 arising out of Mithanpura P.S. Case No. 387 of 2022.
