Mr. Ram Priya Sharan Singh the learned APP for the State has assisted this Court in this case. The petitioner seeks bail in connection with Special Case No. 4159/2020 arising out of P.R. Naubatpur P.S. Case No. 49 of 2020 instituted for the offence under Section 30(a), 32(1)(3), 41(1)(2) of the Bihar Prohibition and Excise (Amendment) Act, 2018. 763.740 litres of liquor is said to have been recovered from a room situated besides the Boring machine belonging to the petitioner. A motorcycle also parked near the place of recovery has been seized. Learned counsel for the petitioner submits that the recovery is from a place which is accessible to all

Patna High Court CR. MISC. No.37064 of 2020(2) dt.02-02-2021 2/2 and that he has wrongly been saddled with such recovery.

He is in custody since 26.06.2020.

Regard being had to the nature of accusation and the period of custody of the petitioner, he is directed to be released on bail on his furnishing bail bonds in the sum of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Special Judge, Excise, Patna in connection with Special Case No. 4159/2020 arising out of P.R. Naubatpur P.S. Case No. 49 of 2020.
