JUSTICE ASHUTOSH KUMAR ORAL ORDER 18-05-2018 The petitioner seeks bail in connection with Laheriasarai P.S. Case No. 482 of 2017, dated 20.11.2017, instituted for the offences punishable under Sections 393 and 307 of the Indian Penal Code.
Two persons, with the purpose of robbing the informant, put their hands in the pocket of the informant. On protest by the informant, he was inflicted a knife blow. The First Information Report has been lodged against two unknown persons. The name of the petitioner has transpired in the confession of co-accused/Hira Sahani. Nothing has been recovered from the possession of the
Patna High Court Cr.Misc. No.26329 of 2018 (3) dt.18-05-2018 2/2 petitioner and he has not been put on Test Identification Parade. The entry in the impugned order that a knife has been recovered from the possession of the petitioner is stated to be an error of record.
The petitioner is in custody since 16.03.2018 and the case in which he has been earlier made accused, he is on bail.
Regard being had to the aforesaid facts, the petitioner, above named, is directed to be released on bail on his furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Darbhanga in connection with Laheriasarai P.S.
