The petitioner seeks bail in Laheriasarai P.S. Case No. 594 of 2016 registered under Sections 399, 400, 402 and 414 of the Indian Penal Code and Sections 25(1-b)a, 26 and 35 of the Arms Act.

The police got information that some criminals are assembled near the petrol pump, Donar Chowk, Darbhanga and they were committing cognizable offence. The police raided the place and on chase apprehended four persons, namely, Ravinandan Kumar @ Chhotu, Raj Kumar Gupta, Basant Kumar Gupta (the petitioner) and Sanjay Kumar Yadav. On search, one mobile was recovered from the house of the petitioner. The petitioner is in jail since 19.12.2016.

Considering the facts aforesaid that only one mobile was recovered from the possession of the petitioner and the petitioner has remained in jail for four months, the above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Darbhanga in connection with Laheriasarai P.S. Case No. 594 of 2016.
