The petitioners apprehend their arrest in connection with a case registered for the offences punishable under Sections 447, 147, 148, 149, 323, 324, 307, 436, 504, 379 of the Indian Penal Code.
Learned counsel for the petitioners submits that the petitioners are alleged to be members of an unlawful assembly which led to an altercation between the parties. He further submits that with regard to the same occurrence these petitioners have earlier filed a counter case bearing Mehsi P.S. Case No.11 of
Patna High Court Cr.Misc. No.30830 of 2015 (2) dt.12-08-2015 P2/2 2014.
Considering the nature of allegation made in the First Information Report and that there is land dispute between the parties and also that the petitioners have no criminal history, let the petitioners above named, in the event of their arrest / surrender within a period of two weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) each with two sureties of the each amount to the satisfaction of the learned Chief Judicial Magistrate, Motihari (East Champaran) in connection with Mehsi P.S. Case No.14 of 2014 subject to the conditions as laid down under Section 438(2) of the Cr. P.C. (Anjana Mishra, J) Saif/- U T
