JUSTICE SANJAY PRIYA ORAL ORDER 06-03-2017 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in Trial No. 47 of 2016 arising out of Minapur P.S. Case No. 120 of 2016 instituted for the offence under Sections 376, 511 of the Indian Penal Code and Section 8 of POSCO Act.
As per allegation, the petitioner attempted to commit rape with the daughter of the informant aged about 15 years. It has been submitted that the petitioner is in custody since 19.6.2016. It is mentioned in paragraph-3 of the bail petition that the petitioner has no criminal antecedent. Considering the aforesaid facts and circumstances of the case, prayer for bail of the petitioner is allowed. Let the petitioner above named, be released on bail on furnishing bail
Patna High Court Cr.Misc. No.7899 of 2017 (2) dt.06-03-2017 2/2 bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned 1st Additional Sessions Judge cum Special Judge, POSCO, Muzaffarpur, in connection with Trial No. 47 of 2016 arising out of Minapur P.S. Case No. 120 of 2016, subject to the condition that both the bailors will be the close relatives of the petitioner.
