JUSTICE BIRENDRA KUMAR ORAL ORDER 07-03-2017 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State. Petitioner is languishing in custody for the offences punishable under Sections 341/342/323/302/364/420/34 of the Indian Penal Code.

According to First Information Report, the F.I.R. named four accused persons assaulted to Sita Devi as a result whereof she died. The reason for the occurrence is that the accused persons alleged that Sita Devi had cut the crop from the land of the petitioner. At the time of hearing of prayer for anticipatory bail of co-accused Ranjeet Rai @ Ranjit Kumar Rai and Ashok Rai the case-diary was perused, which revealed that in the further statement the informant and some other eyewitnesses

Patna High Court Cr.Misc. No.9096 of 2017 (2) dt.07-03-2017 2/2 levelled allegation of assault only against the petitioner. Considering the aforesaid conflicting statement, let petitioner, above named, be enlarged on bail on furnishing bail bond of Rs.10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-III, Dalsingsarai, Samastipur/Successor Court, in connection with Vidyapatinagar P.S. Case No.107 of 2016. (Birendra Kumar, J) Mkr./- U T
