Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.

The petitioner apprehends his arrest in connection with Dehri (Town) P.S. Case No. 288/2016 registered for the offences punishable under Sections 147/148/337/353/379/411 of the Indian Penal Code, Section 40(i) B.M. Act, Sections 40(1A) & 21(i) of the D.E. Act, Section 33/41/42 of the Forest Act and Section 47(a)(c) & 50 of the Bihar Prohibition and Excise Act.

Learned counsel for the petitioner submits that similarly situated accused has been granted anticipatory bail

Patna High Court CR. MISC. No.49348 of 2021(3) dt.22-03-2022 2/2 vide order dated 01.07.2017 passed in Cr. Misc. No. 22294 of 2017.

Considered the aforesaid anticipatory bail application. Taking into consideration the facts and circumstances of the case and on the ground mentioned in the order dated 01.07.2017 passed in Cr. Misc. No. 22294 of 2017, the present anticipatory bail application is allowed.

Accordingly, let the petitioner above named be released on bail, in the event of his arrest or surrender before the court below within a period of four weeks from today, on furnishing bail bonds of Rs.10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned 2nd Additional District and Session Judge cum Special Judge, Excise, in connection with Dehri (Town) P.S. Case No. 288/2016, subject to the conditions as laid down under Section 438 (2) of the Cr.P.C.
