The petitioner, who is in custody, seeks bail in connection with Khizarsarai P.S. Case No. 125 of 1994 (Tr. No. 603A of 2017) registered for the offences punishable under Sections 147, 149, 341, 323 and 307 of Indian Penal Code. Petitioner was granted regular bail in this case in 2006 itself, but his bail bond was cancelled because of his nonappearance on 13.02.2006. Thereafter petitioner was declared absconder and process were issued under Section 82 and 83 Cr.P.C. Petitioner was apprehended by police on 17.12.2017 and since then he is in custody.
It has been submitted on behalf of the petitioner that he will not misuse the privilege of bail any further and he
Patna High Court Cr.Misc. No.31324 of 2018(5) dt.13-08-2018 2/2 remained in custody for more than eight months as such he may be granted regular bail.
Considering the aforesaid fact and circumstances of the case, let the petitioner named above be released on bail upon furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge IVth, Gaya, in connection with Khizarsarai P.S. Case No. 125 of 1994 (Tr. No. 603A of 2017). Petitioner shall remain present on each and every date and non-appearance on two consecutive dates without any valid reasons, the trial court shall be at liberty to cancel his bail bond. (S.
