JUSTICE RAJEEV RANJAN PRASAD ORAL ORDER 24-02-2021 Heard learned counsel for the petitioner and Mr. Akhileshwar Dayal, learned A.P.P. for the State. This is the second attempt of the petitioner to obtain regular bail in connection with S.T. No. 519 of 2019 arising out of Tajpur P.S. Case No. 106 of 2019 registered for the offence under Section 302, 506 of the Indian Penal Code and 27 of the Arms Act.

Earlier the prayer of bail of the petitioner was rejected by this Court on 26.11.2019 passed in Cr. Misc. No. 76091 of 2019 (Annexure '1').

The trial court's report has been received. It appears that the prosecution evidence has already been closed and the

Patna High Court CR. MISC. No.38458 of 2020(3) dt.24-02-2021 2/2 case is fixed for statement under Section 313 Cr.P.C. The learned trial court has reported that if the trial work of the court will go on smoothly then the case is likely to be concluded within three months.

Considering the aforesaid report, this Court is not inclined to grant privilege of regular bail to the petitioner at this stage.

Let the trial be concluded.
