JUSTICE JITENDRA KUMAR ORAL ORDER 25-08-2023 This miscellaneous case has been filed for modification of the order dated 25.02.2023 passed by this court in Criminal Miscellaneous Case No. 2067 of 2023 whereby the petitioner was directed to be released on bail subject to the conditions, one of them being:

"iv. In case, it is brought to the notice of the court below that the petitioner has criminal antecedents other than the disclosed one, Ld. Court below shall cancel the bail bonds of the petitioner after hearing him and getting satisfied that the petitioner has concealed his criminal antecedents despite his knowledge of the same."

2. However Ld. Counsel for the petitioner further submits that inadvertently the petitioner had failed to mention

Case No. 95 of 2022, in which the petitioner is also one of the accused and hence this criminal antecedent is not reflected in the order. However, for such lapse on the part of the petitioner, the petitioner is offering un-conditional apology. 3.Hence, this criminal antecedent should be also read as internal part of the previous order dated 25.02.2023 passed by this court in Cr. Case N0. 2067 of 2023 and court below may entertain with the bail bond accordingly after three months from today.

4. This modification petition is disposed of accordingly.
