The petitioner has been in custody since 31.01.2018 in connection with Matiyariya P.S. Case No. 03/2018 registered for the offences punishable under Sections 414/379/427//34 of the Indian Penal Code and Section 33/41/42 of the Indian Forest Act. Learned counsel for the petitioner submits that admittedly the petitioner was not arrested from the van which is said to have been loaded with Khaira wood and on suspicion they have been chased and apprehended. It is further submitted that similarly situated co-accused persons who were also apprehended from the spot have since been extended the privilege of bail in Cr. Misc. No. 18396 of 2018.
Considering the aforementioned facts and
Patna High Court Cr.Misc. No.19246 of 2018 (3) dt.02-05-2018 2/2 circumstances and that the petitioner is having two other cases, let the petitioner above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate, 1st, Bettiah, West Champaran, in connection with Matiyariya P.S. Case No. 03/2018, subject to the condition that the petitioner shall remain physically present in court on each and every date during trial and in the event of failure on two consecutive dates without sufficient reasons, his bail bonds shall be liable to be cancelled by the learned court concerned.
