The petitioner has preferred this application for grant of regular bail in a case registered under sections 25(1-B)(a), 26 and 27 of the Arms Act.

As per the prosecution case, a loaded country-made pistol and a live cartridge was recovered from the possession of the petitioner.

It is submitted by learned counsel for the petitioner that no incriminating article has been recovered from his possession. He has been falsely implicated in the case because of his antecedent. He is in custody since 30.4.2021 and chargesheet has been submitted in the case.

Having heard learned counsel for the parties and

Patna High Court CR. MISC. No.49533 of 2021(2) dt.22-02-2022 2/2 taking into consideration the facts of the case together with the petitioner having remained in custody for 9 months, the petitioner is directed to be enlarged on bail in connection with Durgawati P.S. Case no. 101 of 2021 on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Kaimur (Bhabhua).
