JUSTICE VINOD KUMAR SINHA ORAL ORDER 29-03-2017 The application is for grant of regular bail in connection with Beur P.S. Case No. 288 of 2016 registered for offences under sections 20/22 of the N.D.P.S. Act. It has been submitted on behalf of the petitioner that nothing has been recovered from his possession and his name transpired only on confessional statement of co-accused. He is in custody since 23.11.2016 and now the charge has been framed in this case.
Heard learned A.P.P. also.
Having heard both sides, in view of the recovery and the allegation, this Court is not inclined to grant bail to him at this stage. As the charge has been framed in this case, the trial court is directed to expedite the trial and conclude the same within a
Patna High Court Cr.Misc. No.14442 of 2017 (2) dt.29-03-2017 2/2 period of nine months from the date of receipt or production of a copy of this order. If the trial is not concluded within the aforesaid period, the petitioner will have liberty to renew his prayer for bail. With the above observation/direction, this petition is dismissed.
