1. Heard Mr. Sandip Kumar Gautam, learned counsel for the petitioner and Mr. Binod Kumar No.3, learned APP for the State.

2. The petitioner seeks regular bail in connection with Birpur P. S. Case No. 54 of 2022, dated 10.05.2022 registered for the offence punishable under Section 379 of the Indian Penal Code.

3. The main submissions advanced by the petitioner's counsel are that the instant matter relates to the theft of a motorcycle of the informant and the said motorcycle has been recovered during the course of investigation but from the house of the co-accused Dilkhush Kumar, who has been granted bail by the coordinate Bench of this court vide order dated 19.08.2023 passed in Cr. Misc. No. 49990 of 2023. It is lastly

4. Learned APP appearing for the State has opposed the bail prayer of the petitioner.

5. Considering the aforesaid submissions advanced by the petitioner's counsel, this court is inclined to grant him the relief of bail. Accordingly, let the petitioner named-above be enlarged on bail in connection with Birpur P. S. Case No. 54 of 2022 on furnishing bail bond of Rs. 20,000/- (Twenty Thousand) with two sureties of the like amount each to the satisfaction of the Court concerned.
