2. Petitioners seek regular bail in a case registered for the offence punishable under sections 414, 309, 120B of the Indian Penal Code.

3. As per the prosecution case, petitioners committed theft of construction materials.

4. Learned counsel appearing for the petitioners submits that the petitioners are brothers and they are innocent and have falsely been implicated in this case. No incriminating article have been recovered from the conscious possession of the petitioners. Charge sheet has already been filed. Petitioners

Patna High Court CR. MISC. No.44413 of 2024(3) dt.25-10-2024 2/2 are in custody since 1.3.2024.

5. Considering the aforesaid facts of the case, prayer for regular bail of the petitioners is allowed. Let the petitioner, mentioned above, be enlarged on bail on furnishing bail bond of Rs.10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Buxar in Dumraon Police Station Case No. 65 of 2024.
