JUSTICE SUDHIR SINGH ORAL ORDER 06-09-2016 Heard learned counsel for the petitioner and learned counsel for the State.

The petitioner is languishing in custody in connection with Shashtri Nagar P.S. Case No. 131 of 2016 for the offences instituted under Sections 363 and 366(A) of the Indian Penal Code.

There is allegation against the petitioner for committing abduction of the minor daughter of the informant. It has been submitted on behalf of the petitioner that the petitioner is in custody since 01.04.2016. The charge sheet has been submitted in the present case. The petitioner has got no criminal antecedent. There is no allegation of tampering of witnesses alleged against the petitioner. The victim girl has been

Patna High Court Cr.Misc. No.29851 of 2016 (3) dt.06-09-2016 2/2 examined under section 164 of the Cr.P.C., in which, she has not named the petitioner. The other independent witnesses, examined in paragraph-98 and 99 of the case diary have stated that there was love affair between the petitioner and the victim and she has left her place on her own will.

On behalf of the state it is submitted that the petitioner is named in the First Information Report.

Considering the aforesaid facts and circumstances, let the petitioner above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the Smt. Aditi Gupta, learned Judicial Magistrate, 1st Class, Patna, in connection with Shashtri Nagar P.S. Case No. 131 of 2016.
