Petitioner seeks bail in connection with Mozahhidpur (Babarganj ) P.S. Case No. 66 of 2012, S. Tr. No. 809A/2013, registered under Section 395 of the Indian Penal Code.

Learned counsel for the petitioner submits that this is a case of misuse of privilege of bail. In fact, petitioner being a labourer had gone to Delhi to earn his livelihood and as such he could not represent his case. Petitioner is in custody since 23.09.2016.

Considering the facts and circumstances of the case, the petitioner above named is directed to be released on

Patna High Court Cr.Misc. No.7743 of 2017 (2) dt.20-03-2017 2/2 bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Additional District Judge 3rd, Bhagalpur in connection with Mozahidpuir (Babarganj) P.S. Case No. 66 of 2012, Sessions Trial No. 809A of 2013.
