ANJANA MISHRA ORAL ORDER 11-05-2018 Heard learned counsel for the petitioner and the learned counsel appearing on behalf of the State. The petitioner is in custody since 09.02.2018 in connection with Sour Bazar P.S. Case No.611 of 2017 registered for the offence under Sections 365, 302, 201, 120B, 34 of the Indian Penal Code.
Learned counsel for the petitioner submits that the present petitioner has been taken into custody on the basis of suspicion as the father of the petitioner has leased out his house to Uday Kumar and Vijay Kumar and they were running a Coaching Centre. It is further submitted that save and except the suspicion, there is no material worth the name in the case diary to connect the petitioner with the disappearance of the boy and
Patna High Court Cr.Misc. No.22434 of 2018 (3) dt.11-05-2018 2/2 his subsequent killing. Learned counsel for the petitioner further submits that the petitioner has no criminal antecedents. In view of the aforementioned facts and circumstances and there being no further material in the case diary, let the petitioner, above named, be released on bail on his furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Saharsa, in connection with Sour Bazar P.S. Case No.611 of 2017.
