1. Heard learned counsel for the petitioner, learned A.P.P. for the State and learned counsel for the opposite party no.2/complainant.

2. The petitioner has preferred this application for grant of anticipatory bail apprehending his arrest in connection with Complaint Case no.1058 of 2021 registered under sections 307, 498A, 379, 504 and 323 of the Indian Penal Code and sections 3/4 of the Dowry Prohibition Act.

3. As per the prosecution case, the petitioner was married to the complainant in the year 2019. It is stated that soon after the marriage the accused persons started to torture the complainant for non-fulfillment of the demand of dowry by way

Patna High Court CR. MISC. No. 37637 of 2025(3) dt.08-10-2025 2/3 of a four-wheeler vehicle and Rs.7 lacs in cash. The complainant was abused, assaulted and forced out of the house.

4. Learned counsel for the petitioner submits that the petitioner has been falsely implicated in the case only for the reason of his being the husband of the complainant. The allegations of demand of dowry, torture and assault are all false and concocted. The petitioner has always been ready to live amicably with the complainant. He has no criminal antecedent.

5. The application for anticipatory bail is opposed by learned A.P.P. for the State and learned counsel for the opposite party no.2/complainant. It is submitted by learned counsel for the complainant that the petitioner happens to be the husband of the complainant and there is direct allegation of abuse and assault against him. The complainant has always been ready to live with the petitioner amicably.

Having heard learned counsel for the parties and taking into consideration the nature of allegations against the petitioner in the complaint, together with the petitioner not having any criminal antecedent, in the facts of the case it is directed that the petitioner above named, in the event of his arrest or surrender before the learned Court below within a period of four weeks, be released on anticipatory bail in
