JUSTICE BIRENDRA KUMAR ORAL ORDER 11-04-2017 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State. Petitioner is languishing in custody for the offences punishable under Sections 302/120B of the Indian Penal Code and Section 27 of the Arms Act.

The deceased was a business partner of Chandra Shekhar Gupta and suspicion is against Chandra Shekhar Gupta to have committed murder for business dispute.

Submission is that Chandra Shekhar Gupta has already been allowed bail by a coordinate Bench of this Court in Cr. Misc. No.26968 of 2013. Name of the petitioner had transpired in the confessional statement of Chandra Shekhar Gupta.

No.17281 of 2017 (2) dt.11-04-2017 2/2 Considering the aforesaid facts, let petitioner, above named, be enlarged on bail on furnishing bail bond of Rs.10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Sessions Judge, Bhagalpur/Successor Court, in connection with S.T. No.383 of 2013/S.T. No. 682 of 2016, arising out of Sabour (Goradih) P.S. Case No.28 of 2013, with condition that petitioner shall fully cooperate with the investigation and trial of the case, failing which the Court-below shall be at liberty to take steps for cancellation of the bail-bonds of the petitioner in this case.
