2. This is the second bail application filed on behalf of the petitioner for grant of regular bail in connection with Sessions Trial No. 15 of 2024 arising out of Sahebganj P.S. Case No. 65 of 2023 registered for the offence under Sections 341, 323, 307, 324/34 of the Indian Penal Code and later Section 302 of the Indian Penal Code was also added.

3. As per the prosecution case, the petitioner and others are said to have tortured the deceased by inserting a glass in his anus which was removed after surgery and thereafter the victim died.

4. Learned counsel for the petitioner submits that in the pending trial out of seven witnesses, five witnesses are yet to be examined and therefore the petitioner may be granted bail.

5. In view of the gravity of the offence, this Court is not inclined to grant bail to the petitioner.

6. Accordingly, this application is dismissed.

7. The Senior Superintendent of Police, Muzaffarpur is directed to ensure the attendance of the witnesses in the trial and submit a report in this Court.

8. Let a copy of this order be communicated to the Senior Superintendent of Police, Patna through FAX for its compliance.
